1. Agreement to Terms

Welcome to TacTrader ("TacTrader," "we," "us," or "our"). TacTrader is a community marketplace platform where members can list, discover, and trade pre-owned tactical gear and accessories. By accessing or using our website, services, or any associated features (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and TacTrader. Your continued use of the Platform following any changes to these Terms signifies your acceptance of those changes.

2. Nature of the Platform

TacTrader operates as a peer-to-peer listing and community platform for tactical gear accessories. We provide a venue where registered members can post listings, communicate with other members, and arrange transactions for pre-owned tactical equipment.

It is important to understand that TacTrader does not broker, mediate, or participate in any transaction between users. We do not hold funds, process payments, provide escrow services, inspect items, or facilitate the physical exchange of goods. All dealings, including negotiation, payment, and shipping, occur directly between the buyer and seller. TacTrader is not a party to any transaction conducted through the Platform.

3. Eligibility & Account Registration

To use TacTrader, you must be at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement. By creating an account, you represent and warrant that you meet these requirements.

When registering for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorized use of your account or any other breach of security.

TacTrader reserves the right to require identity verification at any time, including but not limited to verifying your age, identity, or location. Failure to comply with a verification request may result in the suspension or termination of your account.

4. Compliance with Laws

You are solely responsible for ensuring that your use of the Platform, including any items you list, purchase, sell, or trade, complies with all applicable federal, state, and local laws, regulations, and ordinances. This includes, without limitation, laws governing the sale, transfer, possession, and shipping of tactical gear and accessories in your jurisdiction and the jurisdiction of any other party involved in a transaction.

TacTrader does not provide legal advice and makes no representation that any particular item or transaction is lawful in your jurisdiction. It is your responsibility to understand and comply with the laws that apply to you. Ignorance of applicable law is not a defense and does not excuse violations of these Terms.

5. Acceptable Use

By using TacTrader, you agree to the following rules of conduct. You shall not:

  1. Violate any applicable local, state, national, or international law or regulation in connection with your use of the Platform.
  2. Attempt to gain unauthorized access to any portion of the Platform, other user accounts, or any systems or networks connected to the Platform.
  3. Sell, trade, transfer, or share your account credentials with any third party, or operate another user's account without their express permission.
  4. Engage in spamming, data harvesting, scraping, or the unauthorized collection of user information from the Platform.
  5. Use bots, scripts, crawlers, or other automated tools to access, interact with, or extract data from the Platform without our prior written consent.
  6. Impersonate any person or entity, or misrepresent your identity, affiliation, or the origin of any content you submit.
  7. Tamper with, reverse engineer, or interfere with the proper functioning of the Platform, its security features, or any protective measures.
  8. Place excessive load on our infrastructure, attempt denial of service attacks, or otherwise abuse Platform resources in a manner that degrades the experience for other users.
  9. Assist, encourage, or enable any other individual or entity in violating these Terms or any applicable law.

6. Content Standards

All content you post, upload, or share on TacTrader, including listings, comments, images, and messages, must adhere to the following standards:

  • Content must be lawful and must not promote, facilitate, or encourage illegal activity of any kind.
  • Content must be accurate and not misleading. Listings must truthfully represent the item's condition, features, and any known defects.
  • Content must not be threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Content must not contain malware, viruses, or any code designed to disrupt, damage, or interfere with the Platform or any user's device.
  • Content must not consist of placeholder, filler, or meaningless text. All listings must contain genuine, substantive descriptions.
  • Content must not disclose the private or personal information of any third party without their explicit consent, including addresses, phone numbers, or financial information.
  • Content must not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

7. Prohibited Conduct

The following activities are strictly prohibited on TacTrader:

  • Offering, listing, or attempting to sell any item classified as prohibited under Section 8 of these Terms.
  • Creating false, fraudulent, or intentionally misleading listings for items you do not possess, do not intend to sell, or that do not match the description provided.
  • Facilitating, soliciting, or conspiring to engage in any illegal act, including the unlawful transfer of restricted items.
  • Circumventing, evading, or attempting to circumvent Platform rules, content filters, moderation decisions, or account restrictions through the use of alternate accounts or any other method.
  • Engaging in price manipulation, shill bidding, or any deceptive trading practice designed to mislead other users.

8. Prohibited Items

TacTrader is a marketplace for tactical gear accessories only. The following items are strictly prohibited and may never be listed, offered, or traded on the Platform:

  • Firearms of any kind— including but not limited to rifles, handguns, shotguns, and any other complete firearm or weapon capable of discharging a projectile by means of an explosive. This is TacTrader's primary prohibition.
  • Unregistered National Firearms Act (NFA) items, including short-barreled rifles, short-barreled shotguns, suppressors, and destructive devices that lack proper registration.
  • Unserialized firearms, "ghost guns," unfinished receivers, 80% lowers, or any component primarily designed to assemble into a complete firearm.
  • Illegal conversion devices, including auto sears, switches, forced-reset triggers where prohibited, or any device designed to convert a semi-automatic firearm to fully automatic operation.
  • Explosives, destructive devices, incendiary materials, or prohibited ammunition types (such as armor-piercing rounds where restricted by law).
  • Stolen, defaced, altered-serial-number, or counterfeit items of any kind.
  • Controlled substances, drugs, or drug paraphernalia.
  • Any item whose sale, transfer, or possession is prohibited under applicable federal, state, or local law.

What IS allowed: TacTrader welcomes listings for lawful tactical accessories, including but not limited to holsters, optics, scopes, red dot sights, tactical lights, lasers, bipods, grips, stocks, handguards, slings, magazines (where legal), plate carriers, body armor (where legal), tactical bags, pouches, MOLLE gear, knives, multitools, ammunition (where legal), eye and ear protection, cleaning kits, cases, safes, and other related gear.

9. Enforcement & Moderation

TacTrader employs moderators and automated tools to uphold these Terms and maintain the integrity of the community. In furtherance of this, TacTrader and its moderators reserve the right to:

  • Review, edit, or remove any content or listing at our sole discretion, with or without notice.
  • Issue warnings, temporarily suspend, or permanently ban any user account that violates these Terms.
  • Restrict or revoke access to specific features or areas of the Platform.
  • Cooperate with law enforcement authorities and comply with valid legal requests, including subpoenas and court orders.
  • Take any enforcement action we deem necessary to protect the safety of our community, the integrity of the Platform, or to comply with applicable law.

Enforcement actions may be taken without prior notice and are at the sole discretion of TacTrader. We are not obligated to provide the reason for any enforcement action, though we may choose to do so.

10. Transactions Between Users

All transactions on TacTrader occur directly between the involved users. TacTrader does not participate in, facilitate, or guarantee any aspect of a transaction, including but not limited to:

  • Negotiation of price or trade terms.
  • Payment processing, escrow, or holding of funds.
  • Verification of item condition, authenticity, or legality.
  • Shipping, delivery, or logistics of any kind.
  • Mediation or resolution of disputes between users.

You acknowledge and agree that you assume all risk associated with transactions conducted through the Platform. TacTrader strongly encourages users to exercise caution, verify items and counterparties before completing a transaction, and use secure payment methods. Trade gear. Trust the community — but verify.

11. User Content & Listings

You retain ownership of all content you submit to TacTrader. However, by posting content on the Platform, you grant TacTrader a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, distribute, and modify your content in connection with the operation of the Platform. This license continues even if you delete your account, to the extent your content has been shared, cached, or archived.

You represent and warrant that you own or have the necessary rights and permissions to post all content you submit, and that your content does not violate the rights of any third party.

TacTrader reserves the right to remove any listing or user content at any time, for any reason, including but not limited to violations of these Terms, reports from other users, or legal requirements.

12. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TACTRADER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TacTrader does not verify the identity, background, or trustworthiness of any user. We do not endorse, guarantee, or vouch for any listing, item, or user on the Platform. We make no representations regarding the accuracy, reliability, completeness, or timeliness of any content posted by users.

We do not guarantee that the Platform will be available at all times, uninterrupted, secure, or free from errors. You use the Platform at your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TACTRADER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY DAMAGES RESULTING FROM TRANSACTIONS BETWEEN USERS.

IN NO EVENT SHALL TACTRADER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD). THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

14. Indemnification

You agree to indemnify, defend, and hold harmless TacTrader, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) any content you post or submit; (c) any transaction you enter into with another user; (d) your violation of these Terms; or (e) your violation of any applicable law or the rights of any third party.

15. Reporting & Law Enforcement Cooperation

TacTrader is committed to maintaining a safe and lawful community. We reserve the right to report any activity we reasonably believe to be illegal, dangerous, or in violation of these Terms to the appropriate law enforcement authorities.

We will cooperate with law enforcement agencies, government officials, and private parties when required by law or when we believe in good faith that such cooperation is necessary to prevent harm, enforce these Terms, or protect the rights and safety of our users and the public. This cooperation may include the disclosure of user information, content, and transaction records as permitted or required by applicable law.

16. Termination

TacTrader may suspend or terminate your account and access to the Platform at any time, for any reason or no reason, with or without notice. Grounds for termination include, but are not limited to, violations of these Terms, suspected illegal activity, extended periods of inactivity, or requests by law enforcement.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

17. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal information. By using TacTrader, you consent to the practices described in our Privacy Policy. We encourage you to review the Privacy Policy carefully. The Privacy Policy is incorporated by reference into these Terms.

18. Governing Law

These Terms and any disputes arising out of or relating to these Terms or your use of the Platform shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within the United States for the resolution of any dispute arising under these Terms.

19. Modifications

TacTrader reserves the right to update, revise, or modify these Terms at any time and at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice through the Platform.

Your continued use of the Platform after the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms. If you do not agree with the revised Terms, you must discontinue your use of the Platform immediately.

20. General Provisions

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

No Assignment. You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of TacTrader. TacTrader may freely assign its rights and obligations under these Terms without restriction.

Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and TacTrader regarding your use of the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.

No Waiver. The failure of TacTrader to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by TacTrader.
